Terms of use

These terms apply when you use bidfence.io, request a free scan, or reserve or buy a plan. Bidfence is operated from New York, NY. By using the service, you agree to them. You must be at least 18 and using Bidfence for a business.

The free scan

The free scan is provided as-is. It shows what we observed in searches made at specific times and from specific places; an ad that ran at another time or in another place may not appear. We don't guarantee it finds every ad. It covers desktop search results in the US.

Paid plans and renewal

• Plans are billed monthly in advance through Stripe and renew automatically each month until you cancel.
• You can cancel at any time from your billing page or by writing to hello@bidfence.io. Your plan stays active until the end of the period you've paid for. We don't refund partial months, except as these terms or the law require.
• We'll tell you at least 30 days before a price change takes effect for your plan.
• Monitoring covers desktop search results in the US, at the check frequency shown for your plan.

Reserving a plan before monitoring starts

If you reserve a plan before monitoring is available, we collect your payment details but don't charge you until monitoring starts on the date shown when you reserved. You can cancel at no cost any time before then. If the start date moves, we'll email you the new date, and you still won't be charged before monitoring starts.

Reports and what you do with them

• Reports show what we observed and estimates of commissions at stake. Dollar figures are estimates based on stated assumptions, not a measurement of your sales.
• Reports aren't legal advice and don't establish anyone's intent. Decisions about warnings, commission reversals or removing affiliates are yours, made under your own program terms and the law.
• Don't publish reports or use them to make public accusations against affiliates or competitors.
• Labels such as "coupon site" describe the kind of site we observed. Only advertisers matched to your partner list or to an ID in an ad's link are shown as your affiliates, and a partner-list match relies on the list you give us.
• Anyone with a report's link can view it. You're responsible for whom you share it with.

Acceptable use

• Request scans and monitoring only for brands you own or represent.
• Don't use Bidfence to harass anyone, to probe or disrupt our systems, or to send automated requests.
• Upload a partner list only if you're allowed to share it with a service provider.
• We may suspend or close accounts that break these terms.

Your responsibility to us

You agree to cover our reasonable costs, including legal fees, if a claim is brought against us because you scanned a brand you don't represent, or because of how you used a report or a warning email, including publishing it.

Third parties

Bidfence isn't affiliated with Google or with any affiliate platform. Platform and company names are trademarks of their owners. We get search results from third-party data providers. Coverage can change if a provider changes or stops its service. If that materially reduces what your plan covers, we'll tell you and you can cancel.

Changes, governing law and disputes

We may update these terms; the date at the top shows the latest version, and we'll email customers about significant changes before they take effect. These terms are governed by the laws of the State of New York. Any dispute will be heard in the state or federal courts located in New York County, New York.

General

If any part of these terms can't be enforced, the rest still applies. These terms are the whole agreement between us about Bidfence. You can't transfer them without our consent; we may transfer them to a company that takes over the service. Not enforcing a term isn't a waiver of it.
